 TERMS CONDITIONS & APPLICATION PROCEDURE
Nanny Network International, the employment agency, is hereinafter referred to as “Nanny Network International” and you, the employer are the Client Family, hereinafter referred to as “the Family”, unless otherwise explicitly specified.
Application Procedure and payments
1. After the Family selects a suitable Nanny, Nanny Network International agrees to make contact with the selected applicant(s) to arrange a personal/telephone interview within 24 hours.
2. The Family agrees to advise Nanny Network International about their decision regarding the Nanny immediately after the interview.
3. Nanny Network International will advise the Family of the Nanny’s decision within 24 hours from the time of the interview.
4. If a Nanny is not suitable for the Family or vice versa, the family can select another Nanny to interview.
5. When both the Family and the Nanny agree to proceed with the placement, fees become payable and an invoice will be raised accordingly. Fees become payable with immediate effect.
6. The Family agrees to return one copy of the employment agreement to Nanny Network International within 5 days of acceptance of the Nanny. For overseas applications, the Family is also required to send an invitation letter and Family photos.
7. The Family agrees to complete and sign the “Family and Nanny house rules” within 48 hours of the Nanny’s work commencement.
Replacement Guarantee
Should the Nanny the Family employs through Nanny Network International leave during the first 3 months of his/her employment, Nanny Network International will offer you a replacement free of charge. Normally, Nanny Network International guarantees to find a replacement within a month. This guarantee becomes void if the reason for the Nanny’s departure is a gross misconduct of the Family or, if the Family has not adhered to either Nanny Network International’s payment terms or to the terms outlined in the employment contract. The Family is requested to ensure that they make use of the Nanny Network International appraisal scheme, since failure to do so might render the guarantee void. Nanny Network International undertakes to replace an unsuitable Nanny or the one that has departed prematurely. However, we cannot offer a refund of placement fees under any circumstances.
Appraisal Scheme
Nanny Network International requests that the Family uses the appraisal scheme at the end of the second week, second month, fourth month and sixth month. This helps to identify any matters or concerns that the Nanny or the Family might need to discuss or resolve. Furthermore, it reduces the risk of miscommunication.
Methods of Payment
Payment can be made by cheque, (payable to “Nanny Network International”), or by Switch or credit card (please note we do not accept American Express), using the card slip enclosed with the brochure.
Payments to Nanny
The Nanny’s salary must be agreed between the Nanny and the Family and confirmed in writing in the employment agreement. The Family is liable to pay the relevant tax and National Insurance to HM Revenue and Customs, unless the Nanny chooses to be self-employed. The Family is responsible for direct payments to the Nanny; normally payment is made weekly in arrears. Nanny Network International will assist with advice and guidelines on all these issues. Holidays
Nannies are to receive 4 weeks paid holiday per year. (One week for every three months worked).
Refund Policy
The placement fee is noon-refundable, except in the unlikely event that Nanny Network International fails to provide the Family with a replacement Nanny. In such an event all fees, except the administration fee of £100, will be refunded to the Family. Once a Nanny commences her employment, no refunds will be made under any circumstances.
Termination of the Nanny's contract
In the event the Family or the Nanny wishes to terminate their contract, the party concerned must give the other party with at least 2 weeks to a month’s notice, and inform Nanny Network International of their decision. The Family and the Nanny should specify an appropriate notice period in their employment contract.
In the event of a gross misconduct by the Family, the Nanny will be entitled to terminate the engagement with immediate effect, and Nanny Network International will have no further obligations to the Family whatsoever.
Treatment of the Nanny
The Family must keep in mind that Nannies are employees and as such should be treated as members of the Family. Furthermore, Nanny’s working hours, payment terms and work responsibilities should be respected, as described in the application form, weekly timetable and employment agreement.
Disclaimer
1. Nanny Network International shall not be liable in any way, method or manner for any loss, damage or expense incurred by the Family arising from interviewing, selecting, contacting, employing, terminating the employment or any related activity of any Nanny applicant(s).
2. Nanny Network International shall not be in any way, method or manner liable for any loss, damage or expense in relation to any activity, associated or connected activity in relation to Nanny Network International seeking a Nanny for the Family, or the introduction by Nanny Network International to the Family of a Nanny, or the engagement of any Nanny by the Family.
3. Nanny Network International strives to be professional when selecting and introducing suitable Nanny candidates to client families. The final decision as to whether to employ the Nanny is that of the Family and may not in any method, manner or action be the responsibility of Nanny Network International.
